Former Justice Kennedy – Worthy Candidate for the ‘Liberty Medal’?

Below is a response to the July 3rd article in the Philadelphia Inquirer, “Liberty Medal for ex-Justice Kennedy” by Michael J. McMonagle, President of the Pro-Life Coalition of Pennsylvania.  Mike makes the argument that Justice Kennedy is not a worthy candidate for the Liberty Medal.  The Inquirer article can be found below.  

Justice Anthony Kennedy deserves to receive the License Medal, not the Liberty Medal.  License is the freedom to do what one wants to do, while Liberty is the freedom to do what one ought to do.

Kennedy defined liberty as license in his opinion (jointly written by Justices Sandra Day O’Connor and David Souter) in the U.S. Supreme Court’s 1992 Planned Parenthood v. Casey decision.  Kennedy admitted that Roe v. Wade‘s Ninth Amendment “right to privacy” justification for a “Constitutional right to abortion” was mistaken.  However, he wanted to “protect” this “right.”  So, he transferred this “right” to the 14th Amendment by re-defining liberty as license in his infamous declaration, “At the heart of liberty is the right to define one’s own concept of existence, of meaning, of the universe, and of the mystery of human life.”

Abortion advocates have used this distorted definition of Liberty to justify the killing of millions of children in the womb, even until birth.  Furthermore, this “abortion liberty” as license-to-kill-the-vulnerable explains the current justification of many legislators for refusing to protect the lives of children who survive abortion.  After all, their mothers have defined the existence of these children as having no value.

Our nation’s Declaration of Independence proclaimed that all human beings are created with a God-given right to life.  America needs to honor our fellow citizens who protect that right.

    Amen. Striving for true freedom by the Grace of God through Jesus Christ does mean, diligently learning Beauty, Truth, and Goodness from God – knowing God to learn objective self-evident truth inalienably given by our Creator. This gives greater interior charity, joy, peace & harmony for our each of us in making life’s decisions, behaviors, and relating to others. We would never distort the Creeds & Rights afforded in our Land to enable laws and adjudications that hurt the dignity and value of *any* human being. Aiding and abetting the ‘air of acceptability’ of things contrary to objective truth, harms the consciences of those who need to be guided in laws & practices of every society, land, & nation – all of whom are under God, whether they admit it or not. Peace.
